    Makes me think of what I heard the other day.

    The guy reconed he will rather die peacefully in his sleep, like his dad did. He said he would not like to die, screaming in terror, like the oaks on the back of his dad's bakkie!

    The Prescription Act 68 of 1969 states that any debt other than that administrated by court ruling automatically expires if not followed up for a period of three years... Take that Planet Fatness!

    Just look at the new NCA also. national credit act. Im not sure what happend to you but the new act is also more consumer freindly.

    Hmmm.. ethical dilemma...

    Do you pay a debt that is legally and actually your's to pay, or do you hide behind a 3yr Prescription act?

    i once cancelled a cell contract that they never cancelled. Got letter of demand and obviously refuse to pay. They black listed me!! Was a hell of a job getting that cleared from ITC.

    That's a no brainer. I was assured that the lumpsump I paid when I signed up was the full amount for a 1 year contract. If any other amounts were added, it's breach of contract and should not be applicable anyway.

    You have a good point there. Like when they suddenly decide to re-new all access cards, and you have to pay for a new one.

    Anyway.. did you have "this is all you have to pay in total for one year" in writing? And did you check that the fine print does not make provision for additional charges. They offer throw in "From time to time additional expenses may be incurred..... etc"

    Well, just to ensure that they do not blacklist me, I paid the outstanding amount. I did however insist on a formal inquiry on the legality of the charge, attached the Prescription Act in PDF format, and requested a signed letter from a superior in the financial department confirming that my account has no outstanding amount, AND that a verified copy of the original signed contract be sent to me... PLUS I left a very colourful writeup on HelloPeter...

    Now I feel better.

    Just back from Ocean Basket. Must say, first time I am not satisfied with the food. Like I said. A customer will not look around if you keep him happy. So now I will find another place to eat. With everything going backward, it will probably take me awhile.

    I've had this a few times...
    What I do... go back there next time... when they take you in and sit downs, say to the waiter... "Hi "fill in waiter's name"... my name is "Ashley", and this is my lovely wife. Last time we were here the service / food / etc was crap. (Tell him what you didn't like). Please don't make me have to look for another restaurant, because I rather like the location of this place."
    Heck.. if you lucky you will find that it's not the waiter who's seating you, but rather the owner/butler etc... which means you will get even better service.

    To date I walk through my local mall and I have 3 restaurants where the waiters know me by name... and I go back there all the time.

    Sometimes a bad experience can turn into something really good.
